Acceptance of terms
By contracting, accessing, or using the MediCita system ("the System"), the client ("the Client") agrees to be bound by these Terms and Conditions. If you do not agree with any of these terms, you must not use the System.
Service description
MediCita is an AI-based medical management system that includes modules for appointment scheduling, digital patient records, clinical document generation, medical marketing, analytics, and a conversational AI agent. The System is provided as a cloud service (SaaS) and is accessed through a web browser.
Plans and usage limits
The System is offered in three plans:
Essential Plan
Up to 2 specialties, up to 150 appointments/month, 1 admin user. Does not include MediDocs, MediPost, or the AI agent with record access.
Professional Plan
Up to 5 specialties, up to 500 appointments/month, 2 admin users, up to 200 MediDocs documents/month, up to 30 MediPost posts/month.
Premium Plan
Up to 15 specialties, unlimited appointments, 5 admin users, unlimited documents and posts, WhatsApp integration.
Excessive use
If the Client exceeds their plan's limits for two consecutive months, Symbiotiq will notify them and propose a plan adjustment. The service will not be automatically interrupted during this process.
Improper use of AI
Use of the AI agent and the content-generation modules is subject to a fair use policy. Symbiotiq reserves the right to limit or suspend access if it detects massive automated use, abuse, or use that compromises system stability for other clients.
Implementation and payment
The implementation fee is a one-time, non-refundable payment. The monthly fee is charged in advance at the start of each period. Failure to pay two consecutive monthly fees entitles Symbiotiq to suspend access. Prices are in Mexican pesos (MXN). Symbiotiq may adjust monthly rates with 30 days' prior notice.
Intellectual property
The System is the exclusive property of Symbiotiq. The Client receives a limited, non-exclusive, non-transferable license to use it. AI-generated content belongs to the Client, who is responsible for reviewing it before professional use or publication.
Data and privacy
The Client is the data controller responsible for the personal data of its patients under the LFPDPPP (Mexico's Federal Law on Protection of Personal Data Held by Private Parties). Symbiotiq acts as data processor. Symbiotiq does not sell, transfer, or share the data with third parties, except when expressly required by law.
Service availability (SLA)
Symbiotiq will aim for 95% monthly uptime. Scheduled maintenance, failures by third-party providers (Vercel, Anthropic API, EmailJS), and force majeure events are excluded. Symbiotiq will not be liable for losses resulting from the System's temporary unavailability.
Client responsibilities
The Client agrees to:
- Use the system for lawful purposes.
- Not circumvent the limits of the contracted plan.
- Verify AI-generated information before using it in clinical decisions.
- Keep their access credentials confidential.
- Not share access with unauthorized users.
Limitation of liability
AI-generated content does not replace professional medical judgment. Symbiotiq's maximum liability will not exceed the equivalent of three months' fees under the contracted plan.
Cancellation and data portability
The Client may cancel with 15 calendar days' prior notice. After cancellation, they will have 30 days to export their data in CSV/JSON format. After that period, the data will be deleted. The implementation fee is non-refundable.
Changes to the service
Symbiotiq may update the System at any time. Changes that affect contracted features will be notified 15 days in advance.
Governing law
These Terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the courts of Tijuana, Baja California.
